Conditions of participation:

‘RISE TO THE CHALLENGE’ is a game offering several series of multiple-choice questions about Otis, the elevator and escalator industry, and the real estate sector.

Participants can take part in the game on the Otis booth at the MIPIM exhibition event taking place in Cannes from 11 to 14 March 2025, by answering the quiz questions.

Any person over 18 years old attending MIPIM may take part in the ‘RISE TO THE CHALLENGE’ game. Employees of Otis and of other companies in the elevator and escalator industry can participate but their results will not be considered for the final calculation of the companies’ ranking.

The quiz runs from 11 March to 12 March 2025 midnight. Participants answer as many series of questions as they wish, but may only play each individual series once. They validate their participation by giving their professional e-mail address before each series. Otis reserves the right to carry out all necessary checks on the identity and professional e-mail address of participants.

Participation in the game is free and independent of any order or purchase of Otis products.

The results of the participants who have not provided their professional e-mail address or who have provided it inaccurately or falsely will not be considered, as will the results of the participants who refuse the collection, recording and use of their professional email address as strictly necessary for the management of the game.

Participation in the quiz implies full and unreserved acceptance of these rules. Failure to comply with the rules will result in automatic cancellation of participation and of the prize award.

Each player's points are tallied and awarded to their company (based on their professional e-mail address). At the end of the operation, at midnight on 12 March, the company with the most points wins the game, provided that it complies with Otis International Trade Compliance.

Awarding of the Prize:

The employees of the Winning Company who took part in the game will be informed by telephone/email on Thursday 13 March morning and will be invited to join the Otis delegates who will present the prize, a donation of 5,000 (five thousand) Euros to the association Les Petits Débrouillards in the name of the winning company, on the same day at midday on the Otis booth.

The prize is not exchangeable for another prize or for its cash value for any reason whatsoever. Otis reserves the right to change the prize without prior notice. Other costs incurred in connection with the use of the prize (e.g. travel costs) will not be covered.

Publication of results

The results and the prize will be announced on the Otis website and its social media channels.

The Winning Company grants to Otis, including its parent company, permission to reference the Winning Company as a participant to the Otis ‘Rise to the Challenge’ game, and a license to use and publish various photographic and video images of the award ceremony, in print and electronic materials. In addition, the Winning Company grants to Otis permission to use all media produced during the award ceremony: photos, videos, interviews, etc. as part of the ‘Rise to the Challenge’ game for other business purposes, only the specific context of the ‘Ruse to the Challenge’ game, on Otis' social media channels, internal and external websites, marketing collateral, internal and external communications and press releases including the annual report, case studies and white papers, in all media, throughout the world.

The Winning Company understands and agrees that due to the publication nature of the Award and use outlined above, publication cannot be withdrawn once granted. However, upon written notice from the Winning Company revoking such approval, Otis shall refrain from any and all new use of the Materials after the date of said notice.

Additionally, Otis grants to the Winning Company permission to use the Award for communications purposes to highlight the Winning Company’s relationship with Otis. The Winning Company shall submit details of the proposed use of the Award to Otis for review and approval prior to each use. Upon written notice from Otis revoking such approval, the Winning Company shall refrain from any and all new use of the Work after the date of said notice.

Rights to modify or cancel the game organized by Otis

Otis reserves the right to interrupt or terminate the game at any time and without notice for important reasons, in particular if the smooth running of the game cannot be guaranteed for technical or legal reasons. In such a case, participants shall have no recourse against Otis.

Otis reserves the right to modify the conditions of participation, as well as to extend or limit the time frame of the game and to modify the prize originally planned, provided that there are objective reasons and that the modification is reasonable. Any legal recourse is excluded.

Should individual provisions of the conditions of participation be or become invalid, this shall not affect the validity of the remaining conditions of participation. The provisions concerned will be replaced by appropriate provisions that best serve the purpose of the invalid provisions.

Notes on personal data protection

Otis saves and processes the data collected exclusively for the purpose of organizing the game and notifying the participants.

Participants, and therefore the Winning Company, are informed that, for public relations purposes, photographs may be taken and communications published (offline and online, globally) for the duration of the game, to promote the game and its prize.

The use of personal data will be limited to this processing and the person concerned, by participating in the game, gives his or her consent to the use of his or her personal data within the scope defined above and legitimate in accordance with Art. 6 (1) f) of the General Data Protection Regulation (EU GDPR).

Furthermore, participants have a right to obtain information about their stored data and, also a right to correction, deletion and restriction of the processing of the data by sending a request to: privacy@otis.com

Disputes and liability

Participation in the quiz implies unreserved acceptance of these rules in their entirety.

Any inaccurate or misleading statement or any fraud by the participant will result in disqualification.

To be valid, any dispute must be sent by registered post with acknowledgement of receipt to the following address: Otis International, Chemin de Blandonnet 8, CH-1214 Vernier (Geneva) - Switzerland.

Otis may not be held liable if, due to a case of force majeure as defined by case law, or any event beyond its control, it is forced to cancel this game.

Otis may cancel or suspend all or part of the game if it appears that fraud has occurred in any form whatsoever in connection with participation in this game.

Otis

• Disclaims all liability in the event of malfunction of the internet network, telephone lines or reception equipment preventing the game from running smoothly. In addition, Otis cannot be held responsible for problems with the delivery.
• Disclaims all liability in the event of technical failure, anomaly, hardware and software of any kind (virus, bug, etc.) caused on the Participant's system, to their computer equipment and to the data stored therein and the consequences that this may have on their personal, professional or commercial activity.
• May, at any time, in particular for technical, updating or maintenance reasons, interrupt access to the site and the quiz it contains. Otis shall under no circumstances be held liable for these interruptions or their consequences. No compensation can be claimed for these effects.

Jurisdiction

These rules are governed by French law. Any dispute relating to the quiz that cannot be settled amicably will be submitted to the competent courts. The Participant acknowledges having read these rules, accepting them unreservedly and complying fully with them.

Les participants peuvent participer au jeu sur le stand d'Otis au salon MIPIM qui se tient à Cannes du 11 au 14 mars 2025, en répondant aux questions du quiz.

Toute personne de plus de 18 ans présente au MIPIM peut participer au jeu "RISE TO THE CHALLENGE". Les employés d'Otis et d'autres entreprises du secteur des ascenseurs et des escaliers mécaniques peuvent participer, mais leurs résultats ne seront pas pris en compte dans le calcul final du classement des entreprises.

Modalités de participation :

RISE TO THE CHALLENGE" est un jeu proposant plusieurs séries de questions à choix multiples sur Otis, l'industrie des ascenseurs et des escaliers mécaniques et le secteur de l'immobilier.

Le jeu se déroule du 11 mars au 12 mars 2025 à minuit. Les participants répondent à autant de séries de questions qu'ils le souhaitent, mais ne peuvent jouer qu'une seule fois à chaque série.

Ils valident leur participation en communiquant leur adresse e-mail professionnelle avant chaque série. Otis se réserve le droit de procéder à toutes les vérifications nécessaires concernant l'identité et l'adresse électronique professionnelle des participants.

La participation au jeu est gratuite et indépendante de toute commande ou achat de produits Otis.

Les résultats des participants qui n'auront pas communiqué leur adresse électronique professionnelle ou qui l'auront communiquée de façon inexacte ou mensongère ne seront pas pris en compte, de même que les résultats des participants qui refuseront la collecte, l'enregistrement et l'utilisation de leur adresse électronique professionnelle strictement nécessaires à la gestion du jeu.

La participation au quiz implique l'acceptation totale et sans réserve du présent règlement. Le non-respect du règlement entraînera l'annulation automatique de la participation et de l'attribution du prix.

Les points de chaque joueur sont comptabilisés et attribués à son entreprise (sur la base de son adresse électronique professionnelle). A la fin de l'opération, le 12 mars à minuit, l'entreprise qui a le plus de points gagne le jeu, à condition qu'elle respecte les règles de l'Otis International Trade Compliance.

Remise du prix :

Les employés de l'entreprise gagnante ayant participé au jeu seront informés par téléphone/email le jeudi 13 mars au matin et seront invités à rejoindre les délégués d'Otis qui remettront le prix, un don de 5.000 (cinq mille) euros à l'association Les Petits Débrouillards au nom de l'entreprise gagnante, le même jour à midi sur le stand d'Otis.

Le prix n'est pas échangeable contre un autre prix ou contre sa valeur en espèces pour quelque raison que ce soit. Otis se réserve le droit de modifier le prix sans préavis. Les autres frais liés à l'utilisation du prix (par exemple, les frais de voyage) ne seront pas couverts.

Publication des résultats

Les résultats et le prix seront annoncés sur le site web d'Otis et sur ses canaux de médias sociaux.

La société gagnante accorde à Otis, y compris à sa société mère, l'autorisation de faire référence à la société gagnante en tant que participante au jeu " Relevez le défi " d'Otis, ainsi qu'une licence d'utilisation et de publication de diverses images photographiques et vidéo de la cérémonie de remise des prix, dans des documents imprimés et électroniques. En outre, la société gagnante autorise Otis à utiliser tous les supports réalisés lors de la cérémonie de remise de prix : photos, vidéos, interviews… dans le cadre du jeu "Relevez le défi", et à d’autres fins commerciales en rappelant exclusivement le contexte spécifique du jeu "Relevez le défi", sur les canaux de médias sociaux d'Otis, les sites web internes et externes, les supports marketing, les communications internes et externes et les communiqués de presse, y compris le rapport annuel, les études de cas et les livres blancs, dans tous les médias, dans le monde entier.

L'entreprise gagnante comprend et accepte qu'en raison de la nature de publication du prix et de l'utilisation décrite ci-dessus, qu’il n’y aura pas de retrait de la publication a posteriori dès lors qu'elle a été accordée. Toutefois, sur notification écrite de l'entreprise gagnante révoquant cette autorisation, Otis s'abstiendra de toute nouvelle utilisation du matériel après la date de ladite notification.

En outre, Otis autorise l'entreprise gagnante à utiliser le prix à des fins de communication pour souligner la relation entre l'entreprise gagnante et Otis. La société gagnante devra soumettre les détails de l'utilisation proposée du prix à Otis pour examen et approbation avant chaque utilisation. En cas de notification écrite d'Otis révoquant cette approbation, la société gagnante s'abstiendra de toute nouvelle utilisation de l'œuvre après la date de ladite notification.

Possibilité de modifier ou annuler le jeu organisé par OTIS

Otis se réserve le droit d'interrompre ou de mettre fin au jeu à tout moment et sans préavis pour des raisons importantes, notamment si le bon déroulement du jeu ne peut être garanti pour des raisons techniques ou juridiques. Dans ce cas, les participants n'auront aucun recours contre Otis.

Otis se réserve le droit de modifier les conditions de participation, ainsi que de prolonger ou de limiter la durée du jeu et de modifier le prix initialement prévu, pour autant qu'il existe des raisons objectives et que la modification soit raisonnable. Tout recours juridique est exclu.

Si certaines dispositions des conditions de participation sont ou deviennent invalides, cela n'affecte pas la validité des autres conditions de participation. Les dispositions concernées seront remplacées par des dispositions appropriées qui répondent au mieux à l'objectif des dispositions invalides.

Protection des données personnelles

Otis enregistre et traite les données collectées exclusivement dans le but d'organiser le jeu et d'en informer les participants.

Les participants ainsi que leur employeur, sont informés qu'à des fins de relations publiques, des photographies peuvent être prises et des communications publiées (hors ligne et en ligne, dans le monde entier) pendant la durée du jeu, afin de promouvoir le jeu et son prix.

L’usage des données personnelles sera limité à ce traitement et la personne concernée en participant au jeu donne son accord pour l’usage de ses données personnelles dans le cadre ci-dessus défini et légitime conformément à l'art. 6 (1) f) du règlement général sur la protection des données ( RGPD).

En outre, les participants ont le droit d'obtenir les informations sur leurs données traitées et, un droit de rectification, d'effacement et de limitation du traitement des données en faisant la demande auprès de : privacy@otis.com

Litiges et responsabilité

La participation au quiz implique l'acceptation sans réserve du présent règlement dans son intégralité.

Toute déclaration inexacte ou trompeuse ou toute fraude de la part du participant entraînera sa disqualification.

Pour être valable, toute contestation doit être envoyée par courrier recommandé avec accusé de réception à l'adresse suivante : Otis International, Chemin de Blandonnet 8, CH-1214 Vernier (Genève) - Suisse.

La responsabilité d'Otis ne saurait être engagée si, par suite d'un cas de force majeure tel que définie par la jurisprudence, ou de tout événement indépendant de sa volonté, elle était amenée à annuler le présent jeu.

Otis pourra annuler ou suspendre tout ou partie du jeu s'il apparaît que des fraudes sont intervenues sous quelque forme que ce soit dans le cadre de la participation au présent jeu.

Otis

• décline toute responsabilité en cas de dysfonctionnement du réseau Internet, des lignes téléphoniques ou du matériel de réception empêchant le bon déroulement du jeu. En outre, Otis ne pourra être tenu responsable des problèmes d'acheminement.
• décline toute responsabilité en cas de défaillance technique, anomalie, matérielle et logicielle de quelque nature (virus, bogue, etc.) occasionnée sur le système du Participant, à son équipement informatique et aux données qui y sont stockées et aux conséquences pouvant en découler sur son activité personnelle, professionnelle ou commerciale.
• peut, à tout moment, notamment pour des raisons techniques, de mise à jour ou de maintenance, interrompre l'accès au site et au quiz qu'il contient. Otis n'est en aucun cas responsable de ces interruptions et de leurs conséquences. Aucune indemnité ne peut être réclamée à ce titre.

Compétence

Le présent règlement est soumis à la loi française. Tout litige relatif au quiz qui ne pourrait être réglé à l'amiable sera soumis aux tribunaux compétents. Le Participant reconnaît avoir pris connaissance du présent règlement, l'accepter sans réserve et s'y conformer pleinement.
